Legal Policy

The Aquatech Corporation, herein after referred to as "Aquatech" - A Nationwide Member-Owned Society of Pool Building & Retailing Professionals, works diligently to insure that our builder and retailer members meet current APSP (Association of Pool and Spa Professionals) Standards for construction, quality and retailing excellence. Aquatech Members are not agents for Aquatech Corporation and do not have the authority to act for or on behalf of Aquatech Corporation.

Privacy Policy

Although Aquatech may work to resolve consumer "open issues", we are not responsible in any way for the construction, renovation and/or servicing of your swimming pool and/or spa. As a consumer, you assume all responsibility of selecting your pool and/or spa builder, renovator, or pool service provider. Further, Aquatech cannot be held responsible for the selection of your builder, renovator, service provider, or project delays, and any other issues pertaining to the construction, renovation, servicing, purchase of your swimming pool or spa, and/or purchase of swimming pool and spa related products.

Customer Responsibilities

In using any and all services provided by Aquatech and/or its members, you acknowledge that Aquatech is not acting as your pool builder, spa dealer, service provider, general contractor, agent, or lawyer. It is your responsibility to select a contractor and to negotiate the terms for any work performed not that of Aquatech. You should consult with appropriate expert advisers to assist in your home improvements and pool/spa construction, including a lawyer regarding contracts, permits, and other necessary job documentation, and an insurance professional regarding the contractor's and your own insurance coverage requirements. Aquatech only performs screening of contractor's business credit, legal standing, and workmanship practices based upon specified objective criteria; Aquatech does not (i) recommend or endorse any specific pool or spa contractor, or (ii) provide advice on which pool or spa contractor or manufacturer to select. Aquatech relies on electronic data provided by third parties, statements made by contractors, contractor site visitations and completed product reviews, and interviews with contractors to determine which contractors and/or retailers to be granted our membership. Due to the inherent time delay in the data gathering process, pending actions or other issues affecting a member's record may have occurred which were not captured by an Aquatech site visitation, Aquatech annual audit, or the third party data sources used. Unless otherwise specifically stated, Aquatech does not endorse any product or service described in, offered on, or linked to the Aquatech web site.

Aquatech Endorsements

A manufacturer is not required to pay us any fees to be listed on our web sites. Periodically, Aquatech recognizes a limited number of manufacturers who, in our opinion, offer superior products and service to their customers. These special endorsements include "Aquatech Approved" and "The Aquatech Society's Choice" recipients. Aquatech only issues "Aquatech Approved" and "The Aquatech Society's Choice" endorsements to manufacturers and service providers who met our stringent quality standards, pass a facility inspection, and achieve consistently high ratings for service and quality from our nationwide membership.

Collection of personally identifiable information

There are instances where Aquatech requests personally identifiable information to provide our visitor with a service or correspondence (promotions, newsletters and mailed brochures). This information, such as name, mailing address, email address, type of request and possibly additional information, is collected and stored in a manner appropriate to the nature of the data requested by Aquatech and is used to fulfill your request. The information you provide is used by Aquatech to improve the services we provide you.

If you request a newsletter and/or other information from us via the Internet, telephone, or mail, you acknowledge and authorize Aquatech to immediately forward your request for information, including personal information such as your name, mailing address, telephone, and email to one or more of our Aquatech Society members and partners. Our partners, who include member builders, member retailers, approved equipment manufacturers, service providers, and financial lenders, may contact you by telephone or send you marketing & promotional information related to their products and services. If you desire to inform us that the information should not be used as a basis for further contact, please use this site's "Contact" link and E-mail your desire to be removed from our contact list. Once notified, Aquatech will respect your request and attempt to notify affiliate partners to the best of our ability to cease any further contact.

Copyrights/Usage

Use, duplication, disclosure or unauthorized hyper linking of the Aquatech web site, materials, photography, virtual 3D graphics, content and/or programming language is expressly prohibited without prior written authorization. Authorization may be obtain by using this web site's "Contact" E-Mail link.

The Aquatech web site pages may contain other proprietary notices and copyright information, which should be observed and followed. Information on this web site may contain technical inaccuracies or typographical errors. Information may be changed or updated without notice. Aquatech may also make improvements and/or changes in the products and/or the programs described in this information at any time without notice. Aquatech makes no representations whatsoever about any other web site, which you may access through this one. When you access a non-Aquatech web site, please understand that it is independent from Aquatech, and that Aquatech has no control over the content on that web site.
